Abstract: With the arrival of the aging society, the pension problem has become an important social problem, especially in the countryside;which is becoming more and more serious, due to maintenance problems and legal disputes being on the rise. Chinas current legal system ofmaintenance plays an important role to guarantee the rights of the elderly, which can not be ignored. But in the current rural area, thelegal system based on the trust of the people cannot solve problem of rural providing for the aged, properly, while the suitable legal system should be established on the foundation of trust property. Therefore, based on the analysis of existing legal system of maintenance and ruralpractical status quo, this paper proposes to perfect legal system of maintenance, to establish a new rural pattern of providing for the aged.
