乡村振兴视域下的农产品地理标志保护

The Protection of Geographical Indication of Agricultural Products from the Perspective of Rural Revitalization

  • 摘要: 我国地理标志资源丰富,地理标志农产品品种繁多,包括水果、蔬菜、茶叶等初级农产品,截至2017年底,农业部登记农产品地理标志2 242个1。保护好农产品地理标志,有利于乡村经济振兴、生态保护和文化传承发展。如何保护好农产品地理标志,直接影响到乡村振兴战略的实施效果。保护好农产品地理标志,法律手段的运用至关重要;但是,我国农产品地理标志的法律保护起步较晚,发展不尽如意,存在法律保护意识淡薄、法律保护体系不完善、法律保护力度不足等问题。鉴于此,本文期望“加强宣传,提高对农产品地理标志的保护意识;完善立法,加快农产品地理标志法律保护体系的构建;强化监管,加强农产品地理标志保护力度”,从而充分发挥法律保护的积极作用,强化农产品地理标志和商标保护,走质量兴农、品牌富农之路,进一步推动乡村经济社会文化的全面振兴。

     

    Abstract: There are a lot of Geographical indication resources in our country, the agricultural products of geographical indication are varied, including fruits, vegetables and tea, all of which are primary agricultural products. By the end of 2017, there were 2 242 geographical indications of agricultural products which were registered in the ministry of agriculture. Protecting geographical indications of agricultural products is conducive to rural economic revitalization, ecological protection and cultural heritage development. How to protect geographical indications of agricultural products, directly affects the implementation of the rural revitalization strategy. To protect geographical indications of agricultural products, the use of legal means is crucial. However, the legal protection of geographical indications of agricultural products in China started relatively late, and the development is not so sufficient, together with weak legal protection consciousness, imperfect legal protection system, lackness of legal protection, and other problems. In view of this, this article expects to strengthen the propaganda and raise the awareness of the protection of geographical indications of agricultural products; perfect the legislation and speed up the construction of a system of legal protection of geographical indications of agricultural products; strengthen supervision and improve the protection of geographical indications of agricultural products,so as to play a positive role in the legal protection, strengthen protection of trademark and the geographical indications of agricultural products, take the path of developing agriculture by high quality and brand, and further promote the comprehensive revitalization of rural economic and social culture.
