Abstract:
Land use is often changed after the transfer of management right in the reform of the separation of agricultural land rights. At present, there are some problems in the transfer of farmland management right, such as imperfect legislation on land use control, ecological damage caused by predatory management, lack of supervision and guarantee mechanism, and light legal responsibility. Improving land use control in the transfer of farmland management rights is conducive to protecting cultivated land, making rational and effective use of land and promoting moderate scale operation. Japan has formed a complete system of laws and regulations in the aspect of land use control, implemented the zoning system of agricultural land use, and paid attention to public participation in legislation and supervision. Through normative research method and comparative analysis method, it is concluded that the land use control in the transfer of farmland management right in China should be improved from the aspects of perfecting systematic legislation, establishing the system of farmland use zoning, perfecting the supervision and guarantee mechanism, and increasing the legal responsibility.
