Conflict and Protection of Female Land Rights and Interests from the Perspective of Structural Functionalism: Taking the Distribution of Female Land Requisition as an Example

  • The state has formulated relatively complete legal provisions to protect female land rights, but female land rights are still being invaded. Gender, customs, and systems provide a rich perspective for studying the infringement of female land rights, but they cannot explain the micro-mechanism of female land rights encroachment under the conditions of respect for gender equality and complete laws. This article introduces the structure-functionalist perspective, which considers the family as an organic whole, and female members, land, and land requisition as a structure that composes the whole. The research finds that the occupation of female land rights and interests within the household is based on the need to maintain the perfection of family functions The dynamic adjustment of the sub-functions is carried out, and the suggestions for protecting female land rights are proposed from the two aspects of establishing the correct value system and reducing the internal discretion of the family.
